Terms of Service

These terms outline the general policies and conditions under which Lifetime Logistics Services LLC provides freight transportation services. Specific terms for your shipment will be detailed in your rate confirmation and Bill of Lading. In case of any conflict, the terms in your signed agreement and BOL take precedence.
1. Definitions
"Carrier" refers to Lifetime Logistics Services LLC, a licensed motor carrier headquartered in Covina, California.
"Shipper" refers to the party booking transportation services, including the consignor, consignee, or their authorized agent.
"Freight" refers to the goods, commodities, or materials being transported.
"BOL" refers to the Bill of Lading, the legal document governing the transportation of freight.
"Services" refers to the freight transportation and related logistics services provided by the Carrier.
2. Scope of Services
Lifetime Logistics Services LLC provides full truckload (FTL), less-than-truckload (LTL), expedited, temperature-controlled, flatbed, power-only, and cross-border freight transportation services across the 48 contiguous United States, Canada, and Mexico.
The Carrier agrees to transport freight from the designated origin to the designated destination using commercially reasonable efforts to meet agreed-upon pickup and delivery times. Transit times are estimates based on normal operating conditions and are not guaranteed unless explicitly stated in the rate confirmation.
The Carrier maintains all necessary federal and state operating authority, including FMCSA authority, DOT registration, and MC authority, as well as C-TPAT certification for cross-border shipments.
3. Shipper Responsibilities
The Shipper is responsible for:
- Providing accurate freight description, including weight, dimensions, commodity type, pallet count, and any special handling requirements.
- Proper packaging, palletizing, and securing of freight to withstand normal transportation conditions.
- Providing accurate pickup and delivery addresses, including contact names and phone numbers.
- Ensuring the freight is ready for pickup at the agreed-upon time and that someone is available to sign the BOL.
- Providing all necessary documentation for cross-border shipments, including commercial invoices, packing lists, and customs documentation.
- Disclosing any hazardous materials and providing required HAZMAT documentation and placards.
- Ensuring loading and unloading is completed within the allotted free time (typically 2 hours for pickup and 2 hours for delivery).
4. Quoting & Pricing
Rate quotes are valid for 30 days from the date of issuance unless otherwise stated. Quotes are based on the information provided by the Shipper at the time of quoting. If the actual shipment differs from the quoted parameters (weight, dimensions, equipment type, origin, destination, or timeline), the rate may be adjusted accordingly.
Quotes include linehaul transportation and applicable fuel surcharges unless otherwise noted. Accessorial charges (detention, layover, tarping, liftgate, residential delivery, etc.) are billed separately and will be disclosed before booking when known.
Fuel surcharges are calculated based on the national average diesel price published by the U.S. Energy Information Administration (EIA) and may adjust between quoting and shipment execution.
5. Payment Terms
Payment terms are net-15 days from the invoice date for established customers with approved credit. New customers may be required to pay in advance or COD for initial shipments until credit is established.
Invoices are issued upon delivery and include all linehaul charges, fuel surcharges, and accessorial charges. Copies of signed BOLs and delivery receipts are provided with each invoice.
Late payments may be subject to a finance charge of 1.5% per month (18% annually) on the unpaid balance. The Carrier reserves the right to suspend services for accounts more than 30 days past due.
Disputed charges must be reported within 15 days of invoice receipt. Undisputed portions of the invoice are due per the standard payment terms regardless of disputes on other line items.
6. Liability & Cargo Insurance
The Carrier maintains Motor Truck Cargo insurance with a minimum limit of $100,000 per load. Higher coverage limits are available upon request for high-value freight and must be arranged before booking.
The Carrier's liability for loss or damage to freight is limited to the lesser of: (a) the actual value of the lost or damaged freight, or (b) the insurance coverage limit in effect for the shipment. The Shipper is responsible for arranging additional insurance for freight valued above the standard coverage limit.
Liability Exclusions: The Carrier shall not be liable for loss or damage caused by:
- An act of God, including weather events, earthquakes, floods, or other natural disasters.
- Acts of public enemies, war, terrorism, or civil unrest.
- The inherent nature or vice of the freight (e.g., spoilage, shrinkage, natural decay).
- Improper or insufficient packaging by the Shipper.
- The Shipper's own acts or omissions in loading, bracing, or securing freight.
- Compliance with laws, regulations, or orders of government authorities.
- Nuclear or radioactive contamination.
- Freight tendered with a declared value lower than actual value.
The Carmack Amendment (49 U.S.C. § 14706) governs the Carrier's liability for interstate freight transportation. Claims are processed in accordance with federal regulations.
7. Claims Procedure
All claims for loss or damage must be filed in writing within 9 months of the delivery date (or, in the case of non-delivery, within 9 months of the expected delivery date). Claims should include:
- Shipment details: BOL number, date, origin, destination, and commodity.
- Description of the loss or damage, including the nature and extent.
- Photographs of the damage (if applicable).
- The claimed amount, supported by commercial invoice or other evidence of value.
The Carrier will acknowledge all claims within 30 days of receipt and will pay, deny, or make a settlement offer within 120 days. Claims that cannot be resolved within 120 days will receive a written status update explaining the delay and providing an estimated resolution date.
Concealed damage must be reported within 5 business days of delivery. Failure to report concealed damage within this window may result in denial of the claim.
8. Detention & Accessorial Charges
Free time for loading and unloading is 2 hours from the driver's arrival at the facility. Detention charges of $50–$75 per hour (or the prevailing market rate) apply after the free time expires, billed in 15-minute increments.
Layover charges of $250–$500 apply when a driver is delayed more than 24 hours due to causes within the Shipper's or Consignee's control (e.g., facility closed, freight not ready, loading delays).
Additional accessorial charges may apply for services including but not limited to: liftgate service, residential pickup/delivery, inside delivery, tarping, re-weighing, reclassification, and storage. These charges will be disclosed before booking when known.
9. Cancellation & Change Policy
Shipments may be cancelled without charge up to 4 hours before the scheduled pickup time. Cancellations within 4 hours of pickup, or after a truck has been dispatched, may be subject to a cancellation fee of $150–$300 to cover dispatched truck costs.
Changes to shipment details (origin, destination, equipment type, timeline) after booking may result in rate adjustments. The Carrier will provide a revised quote before proceeding with changed shipments.
If the Shipper fails to have freight ready at the agreed-upon pickup time (a "dry run"), the Shipper may be charged a dry run fee equal to the linehaul rate or a minimum of $200, whichever is greater.
10. Hazardous Materials
The Carrier transports hazardous materials in compliance with all applicable DOT regulations (49 CFR Parts 171-180). The Shipper must disclose all hazardous materials at the time of quoting and provide:
- Proper shipping name, hazard class, and UN/NA identification number.
- Packing group, if applicable.
- Quantity and type of packaging.
- Emergency contact information and 24-hour telephone number.
- Required HAZMAT shipping papers and certifications.
Failure to properly disclose hazardous materials may result in shipment refusal, additional charges, and the Shipper's liability for any fines, penalties, or damages resulting from non-disclosure.
11. Privacy & Data
The Carrier collects and uses Shipper information solely for the purpose of providing transportation services, processing payments, and communicating about shipments. The Carrier does not sell or share Shipper information with third parties except as required by law or as necessary to complete the transportation service (e.g., providing shipment information to customs brokers for cross-border freight).
GPS tracking data is used for shipment visibility and security purposes. Real-time location data may be shared with the Shipper during active shipments but is not retained or shared after delivery completion.
12. Governing Law & Dispute Resolution
These terms shall be governed by the laws of the State of California without regard to conflict of law principles. Any disputes arising from these terms or the transportation services provided shall be resolved through good-faith negotiations between the parties.
If negotiations fail, disputes shall be submitted to binding arbitration in Los Angeles County, California, under the commercial arbitration rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorney fees and costs.
Federal claims arising under the Carmack Amendment or other federal transportation laws shall be brought in the appropriate federal court.
13. Changes to Terms
The Carrier reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of the Carrier's services after changes are posted constitutes acceptance of the revised terms.
